A United States-based policy advisory and lobbying firm, Von Batten-Montague-York, has raised questions about the possibility of President Bola Tinubu facing legal action in the United States after leaving office, based on its interpretation of documents involving old allegations.
The firm made the claim in a post on its verified X account on Tuesday, while stressing that the records it reviewed do not expressly show that the US government plans to prosecute the Nigerian president.
Its position centres on responses attributed to the United States Federal Bureau of Investigation, FBI, and the Drug Enforcement Administration, DEA, to enquiries concerning allegations dating back more than three decades. The firm said both agencies declined to confirm that no investigation or enforcement proceeding remains active.
According to the firm, the agencies said they were not required to comment on whether a law enforcement investigation or proceeding may exist. It argues that the responses leave open questions about whether any related investigative process remains under consideration.
The firm further linked its assessment to allegations contained in historical case records involving heroin trafficking. It noted that some people connected to the underlying investigation are now dead, while filings by the FBI and DEA refer to evidence including wiretaps.
However, the firm acknowledged that the agencies’ refusal to confirm the existence of an investigation does not establish that criminal charges are imminent. Its assessment that President Tinubu could face prosecution after leaving office is therefore presented as an interpretation of the documents and agency responses, rather than confirmation of an impending US case.
The development places renewed attention on the distinction between unresolved questions raised by historical law-enforcement records and evidence of an active prosecution. The firm says the issue could become more consequential after Tinubu leaves office, when it argues that presidential immunity would no longer prevent possible criminal proceedings.
